AUCTION INFO

All buyers can inspect the vehicles on the day of sale prior to the start of the auction. All Buyers must be 18 years or older.

• To bid you need a valid Picture ID

• A CASH Deposit of $300 or $500 per bid is also required

(Cash for full liquidation is ONLY accepted at our San Diego location until 8pm the day of the sale)

TERMS AND CONDITIONS

All vehicles are sold  "AS-IS, Where Is" with NO guarantees or warranties expressed or implied. 

Must be 18 years or older to bid on any vehicle. NO MINORS OR PETS ALLOWED ON PREMISES. 

Registration

If buyers want to register as a Dealer at our auto auction or to bid online, pre-registration is needed. For pre-registration, contact us at least one business day before the auction day.

Vehicle Inspection/ Preview

The bidder is responsible for the inspection of vehicles PRIOR to bidding. Inspection starts 2 hours prior to the commencement of the auction. Utilize this time at your discretion to do ALL your due diligence. This includes without limitation physical inspection, type of paperwork, and/ or prior history information. All sales are FINAL. Test drives are not permitted. Any person who tampers with the mechanical setting and/ or removes parts from a vehicle (e.g. keys) prior or during the auction will be charged with vandalism (California Penal Code 594 PC). Brownfield Auto Auction is NOT responsible for printed errors or omissions in regard to year, make, model or mileage of vehicles. Brownfield Auto Auction and its representatives are also NOT responsible for any other defect in the title or registration paperwork, including the license plate expiration.

Deposits

EVERY winning bid will require an IMMEDIATE NON-REFUNDABLE CASH deposit of $300.00. Winning bids of $2,000.00 and over will require a deposit of $500.00. Winning bids of $5,000.00 and over may require a higher deposit.
Note: there are fees associated with each purchase that you must add to your bid price. These fees are on the lists that is provided to customers the day of the auction and posted throughout the facility. For more information about fees, please contact us. Failure to leave a deposit will forfeit your future bidding privileges. 

Balance Payment 

Vehicles must be paid & removed by 3pm the following BUSINESS DAY.
The balance due needs to be liquidated only with a CASHIER’S CHECK OR MONEY ORDER. If NOT liquidated 1 business day after the sold date, the buyer will forfeit their deposit(s). If liquidated and vehicle has not been removed from yard 1 business day after the sold date, a storage fee of $25/day (San Diego) or $50/day (Oakland/ Stockton) will be charged. REMINDER: Transportation adjustments and removal of the vehicles from the auction site is the responsibility of the buyer. No exceptions! Brownfield Auto Auction, lessors, and lessees will not recognize any claim for theft or damage. After the sale, vehicles that remain on our lot are at the buyer's risk.

Minimum Bids and Reserves  

All vehicles will be auctioned off with no minimum bid or reserves. Only vehicles such as consignments, have a reserve. If the reserve is not reached, the bid will be sold as an “IF” bid.

“IF” Bids

AKA “OFFERS” are facilitated by the auction and state that a bidder agrees to buy a vehicle “if” the seller will accept the offer within a specific period of time. The sale will only be canceled “if” the SELLER does not accept the offer. Offers are valid until Monday. Bidders that fail to pay for the vehicle after approval of the offer will forfeit their deposit.

Mileage 

All vehicles 10 years and older are sold as “TMU” (TRUE MILEAGE UNKNOWN) unless claimed otherwise. Brownfield Auto Auction and its representatives do not in any way guarantee the odometer to be actual, true or correct. 

DMV/Title & Registration

Buyer is responsible for ALL DMV and Emission Fees. All emission related repairs are the responsibility of the buyer. Our Auto Auction DOES NOT process DMV paperwork for the Buyer. We are NOT affiliated with any DMV Registration or Service business.  Vehicles must be registered after purchasing it. Buyer assumes full responsibility for registration, sales tax, transfer and/or ownership. 

Paperwork

Seller has a certain period of time to deliver the type of paperwork to the buyer after payment of the balance has been processed and cleared. Brownfield Auto Auction and its representatives are NOT responsible for printed errors in regards to type of paperwork, or any other defect in the titling documentation and registration paperwork, including the registration expiration date.

Car Numbers

A number that corresponds to the vehicle being sold appears on the vehicle's windshield.
If you do not make sure you are bidding on the correct vehicle and you are the highest bidder, you will be required to purchase that vehicle. Failure to purchase that vehicle will forfeit your future bidding privileges.

Green Light (if applicable)

Green light warranty is a 1 hour warranty on motor or transmission ONLY and is NON-REFUNDABLE.
If cancellation of the sale based on the green light warranty is accepted by the Manager, vehicle AND paperwork must be returned before the end of the 1 hour time frame. The test drive of the vehicle must also not exceed 20 miles.  

Media Waiver

I hereby grant Brownfield Auto Auction and its representatives and assign an irrevocable and unrestricted right to use and publish images and videos taken of me during or in connection with this event. I also agree that Brownfield Auto Auction owns all rights to them, and the business, its representatives, and assigns may use them for any purpose and in any form, in perpetuity, and without compensation.

Assumption of Risk and Release of Liability

Any person entering our premises for what-ever reason AND at any-given-time, agrees to release Brownfield Auto Auction, all owners, lessors and lessees of any premises involved with the event, all other persons and organizations involved in organizing, operating, conducting, or managing the event, AND all other officers, directors, agents, employees and members from any and all legal liability or responsibility for personal injury, personal loss, death or property damage arising from the event or that occurred on Brownfield Auto Auction´s premises. To the fullest extent permitted by law, I freely and unconditionally agree to assume all inherited risks, hazards, and any, known or unknown, dangers which cannot be eliminated particularly in a public place.

Participation

I willingly agree to comply and abide by rules, terms, and conditions. I also understand that I may withdraw at any time.

NO SE PERMITEN MENORES DE EDAD NI MASCOTAS EN LAS INSTALACIONES. 

Registro

Si los compradores desean registrarse como Dealer en nuestra subasta o apostar en línea, si se necesita registrar previamente. Para registrarse, contáctenos al menos un día hábil antes del día de la subasta.

 Inspección de Vehículos / Vista Previa

El comprador es responsable de la inspección de los vehículos ANTES de apostar. La inspección comienza 2 horas antes del inicio de la subasta. Utilice este tiempo a su discreción para hacer TODA su diligencia debida. Esto incluye, sin limitación, inspección física, tipo de papeleo y / o información de historial previo. Todas las ventas son FINALES. No se permiten pruebas de manejo. Cualquier persona que manipule la configuración mecánica y / o retire piezas de un vehículo (por ejemplo, llaves) antes o durante la subasta serán acusados de vandalismo (Código Penal de California 594 PC). Brownfield Auto Auction NO es responsable de los errores u omisiones impresos con respecto al año, la marca, el modelo o el kilometraje de los vehículos. Brownfield Auto Auction y sus representantes tampoco son responsables de ningún otro defecto en el título o la documentación de registro, incluida la expiración de la matrícula.

Depositos

Cualquier oferta ganadora requerirá un depósito INMEDIATO EN EFECTIVO NO REEMBOLSABLE de $300.00. Las ofertas ganadoras de $2000.00 o mas requerirán un depósito de $500.00. Las ofertas ganadoras de $5,000.00 y más pueden requerir un depósito más alto. Nota: hay tarifas asociadas con cada compra que se deben agregar al precio de oferta. Puede encontrar estas tarifas en la lista que se les proporciona a los clientes el día de la subasta y publicadas en las instalaciónes. Para obtener más información sobre las tarifas, póngase en contacto con nosotros. Si no deja un depósito, perderá sus futuros privilegios de ofertar. 

Pago de Saldo

Los vehículos deben ser pagados y retirados antes de las 3 pm del siguiente DÍA HÁBIL.
El saldo adeudado debe liquidarse solo con un CHEQUE DE CAJA O GIRO POSTAL. Si NO se liquida 1 día hábil después de la fecha de venta, el comprador perderá su(s) depósito(s). Si se liquida y el vehículo no ha sido retirado de la yarda 1 día hábil después de la fecha de venta, se cobrará una tarifa de almacenamiento de $25 por día (San Diego) o $ 50 por día (Oakland / Stockton). RECORDATORIO: Los ajustes de transporte y la retirada de los vehículos del sitio de subastas es responsabilidad del comprador. ¡Sin excepciones! Brownfield Auto Auction, arrendadores, y arrendatarios no reconocerá ningún reclamo por robo o daño. Después de la venta, los vehículos que permanecen en nuestro lote corren el riesgo del comprador.

Ofertas y Reservas Mínimas

Todos los vehículos serán subastados sin oferta mínima ni reservas. Solo los vehículos, como consignaciones, tienen una reserva. Si no se alcanza la reserva, la oferta se venderá como "IF".

“IF” Ofertas

Las “OFERTAS” también conocidas como “IFS” son facilitadas por la subasta e indican que un comprador acepta comprar un vehículo "si" el vendedor aceptará la oferta dentro de un período de tiempo específico. La venta sólo se cancelará “si” el VENDEDOR no acepta la oferta. Las ofertas son válidas hasta el Lunes. Los compradores que no paguen por el vehículo después de la aprobación de la oferta perderán su depósito.

Millaje

Todos los vehículos de 10 años o más se venden como "TMU" (Verdadero Millaje Desconocido) al menos que se indique lo contrario. Brownfield Auto Auction y sus representantes no garantizan de ninguna manera que el odómetro sea real, verdadero o correcto. 

DMV/ Título y Registro

El comprador es responsable de TODAS las tarifas de emisión y DMV. Todas las reparaciones relacionadas con las emisiones son responsabilidad del comprador. Nuestra subasta de automóviles NO procesa la documentación del DMV para el comprador. NO estamos asociados con ningún negocio de Registros o Servicio del DMV.  Los vehículos deben estar registrados después de comprarlo. El Comprador asume toda la responsabilidad por el registro, el impuesto sobre las ventas, la transferencia y / o la propiedad.

Papeleo

El vendedor tiene un cierto período de tiempo para entregar el tipo de documentación al comprador después de que se haya procesado y liquidado el pago del saldo. Brownfield Auto Auction y sus representantes NO son responsables por errores impresos con respecto al tipo de documentación, o cualquier otro defecto en la documentación de titulación y documentación de registro, incluyendo la fecha de vencimiento del registro.

Numero de Carro

Un número que corresponde al vehículo que se vende aparece en el parabrisas del vehículo.
Si no se asegura de que está apostando por el vehículo correcto y usted obtiene la mayor oferta, se le pedirá que compre ese vehículo. Si no compra ese vehículo, perderá sus futuros privilegios de apostar.

Green Light (si es aplicable)

Green light  es una garantía de 1 hora en el motor o la transmisión SOLAMENTE y NO ES REEMBOLSABLE.
Si la cancelación de la venta basada en la garantía de GREEN LIGHT es aceptada por el Gerente, el vehículo Y la documentación deben devolverse antes del final del plazo de 1 hora. La prueba de manejo del vehículo tampoco debe exceder las 30 millas.  

Exención de Medios

Por la presente, concedo a Brownfield Auto Auction y sus representantes y asigno un derecho irrevocable y sin restricciones para usar y publicar imágenes y videos tomados de mí durante o en relación con este evento. También acepto que Brownfield Auto Auction posee todos los derechos sobre ellos, y la empresa, sus representantes y cesionarios pueden usarlos para cualquier propósito y en cualquier forma, a perpetuidad y sin compensación.

Asunción de Riesgos y Exoneración de Responsabilidad

Cualquier persona que ingrese a nuestras instalaciones por cualquier razón Y en cualquier momento dado, acepta liberar a Brownfield Auto Auction, todos los propietarios, arrendadores y arrendatarios de cualquier local involucrado con el evento, todas las demás personas y organizaciones involucradas en la organización, operación, conducción o administración del evento, Y todos los demás funcionarios, directores, agentes, empleados y miembros de cualquier y toda responsabilidad legal o responsabilidad por lesiones personales, pérdida personal, muerte o daños a la propiedad que surjan del evento o que ocurrieron en las instalaciones de Brownfield Auto Auction. En la máxima medida permitida por la ley, acepto libre e incondicionalmente asumir todos los riesgos heredados, peligros y cualquier peligro, conocido o desconocido, que no pueda eliminarse, particularmente en un lugar público.

Participación

Acepto cumplir con las reglas, términos y condiciones establecidas por la subasta. También entiendo que puedo retirarme en cualquier momento.
